General Terms and Conditions

The purpose of these terms and conditions is to establish a business relationship between YXin Sdn. Bhd. (“the Company”) and Members (including “Distributors” and “Consumers”) by observing the mutual understanding of rules in selling the goods of the company. All matters regarding the member administration of the Company shall follow these Terms and Conditions. These rules and regulations shall be applicable to all Members.

  • Member Qualifications
    Any Malaysian national is eligible to register as a “Member” without any restriction on qualification due to age, academic background, career, occupation, gender, religion, or physical disabilities subject to point 2. 

  • Registration of New Members
    1. All members must be registered under their names and Identity Card number as stated in the Malaysia Identity Card, and the Company shall recognize only the qualifications of the registered members themselves. Claims of rights against others shall not be accepted if made by members who joined under other persons’ names. 

    2. Members must select only one type of membership. Commission generated prior to the change of membership status from distributor to consumer will be paid out to members. However, selection of date of membership status change is not allowed. 

    3. Members who have opted for distributor membership must provide documents such as MyKad as required by the Company. 

    4. Members must certify that all the information provided is complete and accurate, including the information of the sponsoring member. If any false or misleading information is found in the members’ registration applications, the Company reserves the right to terminate the membership. 

    5. The company, always, reserves rights to review the membership. Access to the website after registration does not warrant acceptance by the Company. Once the membership is registered, members are not allowed to make any changes to their name and IC number. 

    6. Individual member should only have one account under his/her name. No multiple membership accounts are allowed within the country or abroad.
  • Definition of Member Qualifications
    A Member registered with the Company shall be legally responsible for all activities he or she has performed as an independent Member who conducts sales activities on his or her own with respect to the business policies, marketing plans, and product purchases publicly presented by the Company. 

  • Member Information Management
    1. At the time of registration, the Member shall clearly state his/her personal details, recommendations, and sponsorship in accordance with the document procedures set by the Company, responsibility for any wrong information provided and defects in the submitted documents shall be borne by the submitting party. 

    2. Furthermore, the Member shall notify the Company immediately of any changes made to his or her personal information (address, phone number, bank account details etc.) and other necessary information, and all responsibility (mail return, etc.). The Company will not bear any responsibility if Members fail to receive commission or any other notices.
  • Termination of Membership
    1. The Company reserves the right to terminate any membership without prior notice and with immediate effect or impose a penalty on members because of breach of any of the provisions herein. In determining what actions to take in the event of breach of the Agreement, the Company may consider without limitation the nature and severity of the breach. If members do not agree with the action taken by the company, members may file an appeal within 7 days together with supporting evidence to be submitted to appeal, however, the decision by the Company will be deemed final thereafter. 

    2. A Member’s membership will be terminated in the following cases:
      i. Registration or withdrawal without consent
      ii. Submitting false documents in connection with membership registration
      iii. Causing a serious operating loss to the company. “Serious operating loss” refers to financial loss by the Company due to a loss of company reputation, intentional mass return, or a lawsuit caused by a failure to comply with the Company regulations. 

    3. The Company may terminate the membership of a Member who caused a serious controversy without first suspending his or her membership and a termination of membership terminates all legal relationship between the Member and the Company, and the Member may no longer exercise any of his or her rights as a Member. 

    4. In case of terminating the membership of a Member, the Company may also impose disciplinary actions on the higher-level members (applicable not only direct but to all levels) based on a comprehensive consideration of whether they were aware of the violation beforehand, their obligations to provide adequate training support, and their responsibilities as Higher-level member, depending on the seriousness of the matter. 

Return Policy

YXin provides a policy for Customers to return faulty products within seven (7) days after receiving the package.

  • Customers may initiate a return for their products under these circumstances:
    1. The product ordered is faulty and/or damaged on delivery
    2. The product ordered has reached its expiration date
    3. The product does not match the description ordered (colour, size, material, quantity, etc.)
    4. The product is missing during delivery

  • Returned products can only be exchanged but not refunded. Shipping fees and transportation costs to return the products are borne by Customers. Subsequently, YXin will bear the shipping fees for replacement products to customers. 

  • YXin reserves the right to reject returned products if they are found to be tampered with or partly consumed.

  • YXin is not responsible for any damages sustained by the Customers in the event of false claims or misrepresentation of the products on the Reseller’s part other than the termination of the offending Reseller’s membership.

Shipping Policy

We are using Easy Parcel-Post Laju for shipping all cities in Malaysia. We process your order during business day from Monday to Friday and all orders will be processed on the following day. It might take 2-3 working days to process your order, the process consists of checking of product, payment and packing the product before sending it to the shipping company.

We are not responsible for any loss of the good after shipping company has delivered the parcel to the designated address and any wrong shipment information from customer. Customer need to pay the shipping fee one more time if there is a mistake due to customer’s condition and refuse by customer.

We reserve the right to amend this policy at any time without prior notice.

Standard Delivery

  • Peninsular Malaysia: 2–5 working days.
    Sabah & Sarawak: 5-8 working days.
    Remote area: Additional 2-3 working days.

During peak sale / promotional periods, our delivery may take slightly longer than the usual lead times due to urges in online and offline order volumes

  • Peninsular Malaysia: Additional 3-5 working days.
    Sabah & Sarawak: Additional 3–7 working days.
    Remote area: Additional 3-7 working days.

Free Shipping

Enjoy free delivery within Malaysia (Peninsular Malaysia, Sabah and Sarawak) for orders above RM250 per order. This applies to Standard Delivery with a maximum parcel weight of 10kg.

Collection of Personal Data

In the course of your dealings with YXin, we may have or will request that you provide data and information about yourself, your organisation, your employees and your customers (“Personal Data”) to enable us to enter into commercial transaction with you or to deliver the necessary notices, services and/or products in connection with our business. These are relevant in connection with our business process, execution, including delivery of notices, services and/or products and/or deliverables, client relationship management, planning purposes in connection with future products, new product launches and events including promotional events with business partners within our scope of business undertakings.

Nature of Personal Data Collected

Personal Data collected may be subject to applicable data protection, privacy and other similar laws and may include but not limited to information concerning your name, date of birth, identity card number, passport number, address, gender, race, contact information, e-mail address, residential or postal addresses, information about spouses and/or children, telephone or fax number, preferred mode of communication, credit card details, bank name and other pertinent banking information, where permitted by applicable law.

Purpose of Collection of Personal Data

The Personal Data that has been or will be collected, processed, and used by us for one or more of the following purposes:

  • the delivery of notices, services, products or deliverables and the marketing of such services or products whether present or future, to you; 

  • for you to enter into the necessary agreement and/or contract to purchase the products and/or services from us; 

  • the maintenance and upkeep of customer records and development; 

  • to facilitate payment of our products and services; 

  • those purposes specifically provided for in any service or product offered by us or our partners; 

  • marketing and client profiling activities regarding our latest, products, projects and/or services; 

  • credit assessments, financial and background investigation as and when deemed necessary; 

  • for our internal record keeping; 

  • prevention of crime (including but not limited to fraud and money-laundering); 

  • meeting any legal or regulatory requirements relating to our provision of services and products and to make disclosure under the requirements of any applicable law, regulation, direction, court order, by-law, guideline, circular, code applicable to us or any member companies of our Group; 

  • enable us to send you information by e-mail, regular postal mail, telecommunication means (telephone calls, SMS messages or social media) or internet social media about products and services offered by us and/or via collaboration with selected third parties.; 

  • setting, modification, safekeeping, customer care, customer loyalty card programmes; and/or related services in respect of our products and/or services; 

Disclosure of Personal Data

The information we gather is not sold, given to, or otherwise shared with other organizations for commercial or any other purposes. All marketing materials, mailings, advertisements and/or newsletters will be sent directly to you by YXin Sdn. Bhd and will not be stored, subject to you responding directly to the advertiser. The Personal Data provided to us will be kept confidential and you hereby consent and authorise us to disclose your Personal Data to the following classes of parties:

  • any related companies and/or subsidiaries of YXin Sdn. Bhd, including those incorporated in the future; 

  • our business partners and affiliates that provide related services or products as may be deemed necessary or appropriate in connection with our business; 

  • our auditors, consultants, lawyers, accountants or other financial or professional advisers appointed in connection with our business; 

  • our third-party service providers, third party management companiyes, sub-contractors or other parties as may be deemed necessary or appropriate by us to facilitate your dealings with us; and

  • our appointed service providers deemed necessary or appropriate by us in relation of our loyalty programmes, for the purpose of delivery gift redemption and services. 

Your Personal Data may also be disclosed if the disclosure is necessary for the purpose of preventing or detecting a crime, or for the purpose of investigations or is required or authorised by or under any law or by the order of a court.

External third parties are appointed by us and are legally tasked with processing your Personal Data in line with data privacy principles specified by YXin Sdn. Bhd. Third parties are also held legally responsible for securing your Personal Data at an appropriate level of security in relation to applicable data protection laws and widely accepted industry standards.

Protection of Personal Data

Your Personal Data will be kept and processed in a secured manner. The appropriate administrative and security safeguards, policies and procedures will be implemented, as far as practicable, in accordance to the applicable laws and regulations. We will, as far as practicable, aim to prevent any unauthorized and/or unlawful processing of, and the accidental loss, destruction, or damage to your Personal Data.
